GENERAL• Client must be 18 years or older to agree to these terms.• All commissions will be in my current style.• My commissions are for personal use, however, commercial use can be requested, and an additional will be applied.• It is absolutely prohibited to use my art for AI or any blockchain-related technology, to include NFTs, cryptocurrency, or future inventions in the space.• I reserve the right to cancel a commission for any reason.• Once I have started the commission, I will send a sketch to be approved. During the sketching phase changes can be made, once the piece is colored, color adjustments can be made along with minor adjustments, after anything major will cost.• I retain copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to displaying or advertising the work on websites, social medias, portfolios, public broadcast channels, and more.• Privatization of commissions can be requested.• I require credit in any repost of my work.• Commissions will be sent through email or drive. It is the customers responsibility to download for themselves to keep.• Clients may not copy or trace my work in any way, unless expressly given permission.• Clients may edit their commissioned works in minor ways, such as use in Profile Pictures, Social Media Banners, or Youtube Thumbnails and similar cases.The Client agrees to provide CrescentGem with the following necessary information:• Payment Email required for receiving invoice.• Social Media Handles for proper crediting of commissioned work.• Preferred Name and Pronouns in the case of long term projects that may require months of communication.PAYMENTS• Payment must be taken through VGen or PayPal in USD.• I am not responsible for any mistakes that are made on your part over the course of the transaction.• It is expected that you deposit 100% of the price upfront before I start. If a payment plan is discussed, Each portion of the payment plan will contribute towards the completion of the final piece; payment for each portion is still to be paid upfront, and no progress will be made until done so. Of course if you’d like me to share the sketch before you send over the payment, that can be discussed.• After 100% of the payment is sent (or the initial part of the discussed payment plan), I will start Sketching. The Sketch will then be sent to you.• I will initiate the transaction to avoid accidental transactions. Do not send me any kind of payment until I have confirmed I can accept your commission AND have asked for payment.• If payment is not made in a timely manner (48h) after I've placed the Invoice, the commission will be canceled.
Repeated counts of commissioning a project and failing to pay will result in blacklisting.DEADLINES AND DELIVERY• A commission can take me from 2 weeks to over a month. Check my Trello queue whenever you want a status update.• For small projects, I generally will not send further work-in-progress shots unless requested, so please feel free to ask!• If your order becomes delayed, I will inform you ASAP.• If you need your commission to be made by a certain date you must state so when commissioning me.USEPersonal Use; Reposts on socials, profile picture / banners, schedule art, and printing for personal use only.Partial Commercial use; Streaming and content use.Commercial use; Reselling, merchandise, ads, game or show designs, and album / book covers.REFUNDS• I can refund 100% of the payment only if I have not started working on the sketch.• Refunds are not allowed once the work has been started and / or completed. However, if I fail to complete a commission in a timely manner, I will contact the client about whether they’d like to wait or have a partial refund. If I find that I cannot complete the commission at all, I will send the client a refund.• If we agree on a payment plan and I start the commission after the first deposit has been done, I will not refund your said deposit if you back out of the Payment Plan.COMMUNICATION• Once you’ve commissioned me, please try your best to respond in a timely manner so your commission can be completed. Failing to respond also means a halt on the progress of your commission.
